Terms of Use

1. Identification of the Parties

These Terms of Use (“Terms”) govern the access and use of the BuildLabs platform, available at buildlabs.rytora.ai, provided by:

Hereinafter referred to as “Rytora”, “we”, or “the Company”.

By creating an account or using BuildLabs, you (“User”) agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Description of the Service

BuildLabs is an AI-powered application builder that enables users to describe software applications in natural language and receive production-ready, full-stack code (React, NestJS, Prisma, PostgreSQL). The platform includes:

• AI code generation via natural language prompts
• Real-time preview with isolated containers
• Code export and deployment to third-party services (Vercel, Railway)
• Team collaboration and workspace management
• Database provisioning via Neon (PostgreSQL Serverless)

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your credentials.
• You must be at least 18 years old or have legal capacity to enter into contracts.
• One person or entity may not maintain more than one free account.
• You are responsible for all activities that occur under your account.

4. Plans, Credits & Billing

4.1 Plans

BuildLabs offers four subscription tiers: Free, Pro, Business, and Enterprise. Features, limits, and pricing for each tier are described on our Pricing page.

4.2 Credits

AI generation consumes credits based on output complexity. Credits are categorized as Daily (bonus), Monthly (subscription), and Top-up (purchased). Unused daily credits expire at midnight UTC. Monthly credits may roll over for paid plans (up to 2x cap). Top-up credits never expire.

4.3 Payments

All payments are processed by Stripe. Prices are in US Dollars (USD). Subscriptions renew automatically unless cancelled. Brazilian users may be required to provide CPF or CNPJ for tax compliance.

4.4 Refunds

Subscription fees are non-refundable except as required by applicable law. Unused credits from cancelled subscriptions are forfeited at the end of the billing period. Top-up credits are non-refundable.

5. Acceptable Use

You agree NOT to use BuildLabs to:

• Generate malicious software, malware, or code intended to cause harm
• Create applications that violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, or exploit the platform's AI engine
• Abuse the credit system through automated or fraudulent means
• Upload or generate content that is illegal, harmful, or infringes third-party rights
• Resell or redistribute the platform without authorization
• Circumvent rate limits, security measures, or access controls

Violation of these rules may result in immediate account suspension or termination without refund.

6. Intellectual Property

6.1 Your Code

You own the code generated by BuildLabs for your projects. You are free to export, modify, deploy, and commercialize it. BuildLabs does not claim ownership of your generated code.

6.2 Our Platform

The BuildLabs platform, including its source code, AI models, system prompts, design, branding, and documentation, is the exclusive intellectual property of Rytora AI Technology & Solutions Ltda. All rights reserved.

6.3 Badge Requirement

Free-tier applications must display the “Built with BuildLabs” badge. Pro and higher plans may remove this badge.

7. Third-Party Services

BuildLabs integrates with third-party services including but not limited to Vercel, Railway, Neon, Stripe, GitHub, and Google. Your use of these services is subject to their respective terms of service. Rytora is not responsible for the availability, performance, or policies of third-party services.

8. AI-Generated Content Disclaimer

Code generated by BuildLabs is produced by artificial intelligence and is provided “as is”. While we strive for quality and correctness:

• AI-generated code may contain bugs, security vulnerabilities, or errors
• You are responsible for reviewing, testing, and validating all generated code before deploying to production
• Rytora is not liable for damages resulting from the use of AI-generated code
• Generated code does not constitute professional advice (legal, financial, medical, etc.)

9. Availability & SLA

We aim to provide high availability but do not guarantee uninterrupted service. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Enterprise plans may include custom SLA agreements.

10. Limitation of Liability

To the maximum extent permitted by law, Rytora's total liability for any claims arising from the use of BuildLabs shall not exceed the amount paid by the User in the 12 months preceding the claim. Rytora shall not be liable for indirect, incidental, special, consequential, or punitive damages.

11. Account Termination

• You may cancel your account at any time from your account settings.
• Upon cancellation, your data will be retained for 30 days and then permanently deleted.
• Rytora reserves the right to suspend or terminate accounts that violate these Terms.
• Upon termination, you may export your code before account deletion.

12. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days before taking effect. Continued use of the platform after changes constitutes acceptance.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of the jurisdiction of the Company's registered address, to the exclusion of any other, however privileged it may be.
